Terms of Service

These terms govern your use of the Phenoa app ("the App"), operated by Epipolar Studios ("we", "us", "our"). By using the App, you agree to these terms.

1. Service Description

Phenoa is a plant health companion app that uses AI to analyze photos of your plants and provide health assessments, trend tracking, and care suggestions. The App is available for iOS devices.

2. AI Disclaimer

Plant health analysis provided by Phenoa is generated by artificial intelligence and is intended for informational purposes only. It is not a substitute for professional botanical, agricultural, or horticultural advice. We do not guarantee the accuracy, completeness, or reliability of any analysis. You should not rely solely on Phenoa's assessments for critical plant care decisions.

3. Account

You must create an account to use Phenoa. You can sign in with Apple, Google, or your phone number. You are responsible for maintaining the security of your account. You may delete your account at any time from within the App.

4. Subscriptions

• Phenoa offers a free tier with limited check-ins and an optional premium subscription.
• Premium subscriptions are billed through Apple and auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time through your Apple ID settings.
• Refunds are handled by Apple in accordance with their refund policies.

5. Your Content

• You retain ownership of the photos you take with Phenoa.
• By using the App, you grant us a limited license to process your photos for the purpose of providing plant health analysis.
• You agree not to use the App to upload content that is illegal, harmful, or violates the rights of others.

6. Acceptable Use

You agree not to:

• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use the App for any purpose other than personal, non-commercial plant care.
• Circumvent any usage limits or access controls.
• Use automated tools to access the App or its services.

7. Availability

We strive to keep Phenoa available at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, Epipolar Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, any damage to your plants based on the App's analysis or suggestions.

9. Termination

We reserve the right to suspend or terminate your access to the App if you violate these terms. You may stop using the App and delete your account at any time.

10. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes through the App or by updating the effective date above. Continued use of the App after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles.
